Mediation: Mediation is an assisted negotiation. In this informal process a neutral person conducts discussions among the disputing parties designed to enable them to reach a mutually acceptable agreement on all or any part of the issues in dispute.

Arbitration: Arbitration is the referral of a dispute to one or more impartial arbitrators for a decision based upon the evidence and arguments presented to the arbitration panel. The decision can be either binding or non-binding. Binding arbitration is considered by some to be quicker, simplier and less expensive than litigation.

Case Evaluation: Early Neutral Evaluation or Case Evaluation is a process in which a neutral person or three-person panel, called an evaluator or evaluation panel, after receiving brief presentations by the parties summarizing their positions, identifies the central issues in dispute, as well as areas of agreement, provides the parties with an assessment of the relative strengths and weaknesses of their case, and, if requested, offers an evaluation of the case.

Summary Jury Trial: The Summary Jury Trial is an abbreviated trial with a jury in which litigants present their evidence in an expedited fashion. The litigants and the jury are guided by a presiding neutral person. After an advisory verdict from the jury, the presiding neutral person may assist the litigants in a negotiated settlement of their controversy.

Fact Finding: The parties submit a particular issue or set of issues in a case to the neutral. The neutral determines the relevant facts from the evidence. The parties decide beforehand whether the neutral’s findings are binding or not.
